Welcome to Worldgymchallenge.com (“our website”). Our website is operated by WorldGymChallenge.com Limited (“we”, “our(s)”).

We are committed to fitness and to motivating people to get fit and stay fit longer, helping people achieve more than they thought possible for themselves. In order to create the right online environment to support you, we have created these website use terms that will govern your use of the website. As our website develops, we may need to change these terms from time to time and therefore we reserve the right to do so and suggest you periodically check the website terms for changes. Interpretation
In these terms, where we refer to something in the singular, it also covers the plural and vice versa.  Where we refer to something using a particular gender, it refers to all other genders (where relevant).  These terms are to be interpreted strictly in accordance with English law and will be subject to the exclusive jurisdiction of English courts of law.  Local laws may also apply insofar as they are inconsistent with English law and you are responsible for complying with local legal requirements regarding your use of our web site.

We have included headings in our terms so you can read them easily.  However, the headings do not form part of the contract itself as for legal interpretation purposes and will not affect the meaning of any part of the terms.

Nature and services of WorldGymChallenge.com

Our website exists to promote awareness of the benefits of cross training and to provide a comprehensive source of information and support to allow you to monitor your progress, allowing you to record performance times and compare them with other members of the challenge.  Please note that you will be listed in the branch of the gym at which you have specified in your profile and you will be able to compare results with fellow members of that same branch – if you wish to be involved in more than one gym challenge because you have multiple memberships you will need to register again separately.

 

Results and Entry Service

WGC acts as a portal to advertise your event to local members and members all over the UK and results can be published specific to your gym only or via a events section for all members to see.

 

Service standards, start dates and termination
We promise to use all reasonable efforts to ensure that our website produces a great experience for all users.  With regard to paid for services, you can start to enjoy the services as soon as your payment has cleared but, if you do so, please bear in mind that you will then lose your right to cancel and receive a full refund within seven working days of your order.  We will not refund subscription fees paid for a particular year because, though you may only want to use the service for a limited period, the cost of providing that service to you have been spread over a year and it would be unfair to us to use the service for say three months then cancel, expecting a refund.

Service subscription rates
Our services are available at the annual subscription rates posted on our website from time to time and we will inform you of price increases by email (to the account in your profile before expiry of your annual membership.

Service enhancements
We may introduce new services and enhancements from time to time and use of those features and enhancements will be subject to these terms.

Payment methods and processing
We use www.paypal.co.uk for our payment processing as they provide a safe and secure means of payment for your protection – they accept all major credit and debit cards.  Their terms of business and privacy policy will apply to that part of our dealings and we will not be given your payment details, nor are we responsible for your dealings with them.

Responsibility for your health and safety
As we have said, we are passionate about fitness and are therefore concerned to make sure that you pay proper regard to your personal health and safety when undertaking any fitness programme and in any competition. We must emphasise that it is your responsibility to make sure that it is safe for you to undertake a fitness programme.  We strongly urge you to take advice from a suitably qualified personal fitness instructor or health professional as appropriate. Our website exists to facilitate fitness and we do not to offer instruction. The information contained on our website, including the Frequently Asked Questions page is to assist you, but we cannot guarantee any particular effects from participating in X Training.

Accuracy of information
We make a great deal of effort to ensure the information listed on our site is accurate, honest and reliable.  However, errors and omissions occur and subscription rates may be subject to change without prior notice.  If you have any reason to complain about the accuracy data on our site, can you please contact us with full information with a request for a refund (complaints@worldgymchallenge.com).

We are committed to providing you with an excellent service at all times and your support by working with us to report any errors or omissions, will be much appreciated.

Liability for website content
We pass everything we upload onto our website through up-to-date virus checker software.  However, because virus checker software can never be guaranteed to pick up every digital device that may have an impact on the use of your computer, you are advised to maintain your own up-to-date virus checker software on your own system and to keep regular full backups of your system and its data to minimise loss and disruption to you in the unlikely event of a virus, Trojan, worm or other device having a negative impact on your system.  As we do all we reasonably can to protect you, we will not accept responsibility for any loss caused by any such device that you may pick up from use of our website.

Warranty relating to content you provide and permitted uses
To encourage active participation in events and competitions, we provide chat rooms with webcam, instant messaging and email voice chat.  The facilities are there for members’ enjoyment and use and we ask you in turn to respect others.  In particular, you warrant that:

  • you are aged 11 or over;
  • you will not post or submit, or permit any posting or other submission to our website, of any information image or data which is offensive, defamatory, discriminatory, obscene, contrary to public morals or decency, unlawful, misleading or inaccurate, or which otherwise infringes the rights of any third party or use abusive, insulting, foul, pornographic language;
  • you will not do anything which materially affects (or may materially affect) the functionality of our systems or our website;
  • you will respect all content guidelines appearing on our website;
  • you will not use our website for any lewd or obscene behaviour, recognising that if you do you face immediate cancellation of your membership without warning;
  • you will not upload any material containing any virus, worm, Trojan or other device or software that may materially affect the operation of our website or our systems or the systems of any other user;
  • you will not use our website for commercial purposes and, in particular, not to use our website to send “spam” or other unsolicited commercial material nor to use our website in any way that we (acting with unfettered discretion) think is an abuse of our service.

We recognise that members will want to meet to train and to plan their participation in events and competitions.  You are responsible for your own safety – clearly we cannot accept responsibility for your personal safety under any circumstances.  However, we are committed to our users being fit, having fun and being safe. Please therefore read our Guidelines on Safer Dating. These guidelines are there for your protection and to offer practical tips to enhance safety. However, be aware that nothing we say can completely protect you and you must therefore exercise your own judgement when meeting people and in choosing the activities you get involved in.

We have the right to withdraw, delete and edit any posts and to terminate your subscription or right of access to our website at any time without justification.

We ask our members to report inappropriate conduct to ensure that you enjoy membership of our website.  Whilst we do everything we reasonably can to ensure people behave correctly, we may not be able to prevent all inappropriate behaviour and we do not accept responsibility for anything said or done by our members and any dispute regarding their behaviour is between the members affected.  However, please do bring it to our attention as we may, in our absolute discretion, wish to suspend or terminate a member’s use of our website.

Username and password use
User chooses username and then issued password via email address provided. You will have the opportunity to change them) and you agree to keep your username and password confidential and not to pass it on to any third party for any reason whatsoever.  You agree only to use a username that is not offensive.  You are strongly urged to use a username that is not your own name and personally identifying as otherwise you name is available worldwide including in jurisdictions in the world where there are no adequate data protection laws.  You agree you are responsible for anything done or omitted to be done by anyone using your username and password should you breach these terms or permit (accidentally or otherwise) a third party to gain access to your account. 

You agree to notify us immediately that you become aware that someone may have unauthorised access to your account.  You may not use anyone else’s account at any time.

Your indemnity against liabilities
You agree to indemnify us fully on an ongoing basis against all costs, claims, liabilities and expenses (including reasonable fees for obtaining legal advice) actually incurred by us as a result of your breach of these terms.

No liability for content of other users
We have limited control over the content posted by users and as such cannot accept responsibility for any such content until such time as you bring it to our attention, allowing us a reasonable time for response.

Limitations on our liability
In the interest of creating a fair balance between your interest and ours, we have tried to create limitations that are fair to both of us.  We cannot by law exclude liability for death and personal injury arising from our negligence or for fraud - anything that may otherwise purport to do so in these terms is deemed not to have that affect.

None of our terms are intended to affect your statutory rights and if they do so accidentally, they are to exclusion of those rights.  You will become aware that if there is any such provision please bring it to our attention immediately.

Contents of our website
All materials on our website (including images, trademarks, logos, text content, software, etc) belong either to us or to third parties.  They are protected under UK and international intellectual property laws and we reserve all rights.  You may not reproduce anything on our website without our written permission.  You may not alter or remove any trademark, copyright or other notice from copies of any content.

You may however download material from our website (one machine readable copy and one print copy per page) for your personal use only.  We reserve all rights and title in the downloaded information.

We take the privacy of your personal information very seriously.  We have registered our use of your personal data with the Information Commissioner’s office and our notification reference number under the Data Protection Act 1998 is Z9598890.  Please refer to our privacy policy for details.

We may from time to time link to other websites – please do not treat the existence of any links as us endorsing the relevant websites.  We endeavour not to link to irresponsible websites but cannot intervene in disputes regarding the nature or content of any linked sites or the effect of them on your computer system nor can we accept responsibility for any loss arising from use of such linked sites.  The terms of use and privacy policies of those sites will apply to their use.

General provisions
There terms are not intended to benefit anyone other than you and us.  In any dealings between users and third parties introduced through this website (whether via advertising or otherwise), you will agree your own terms and we cannot and will not intervene or accept liability for any loss to you arising from that relationship.

We will be constantly developing and maintaining our website to enhance the service to you and this may involve the website being unavailable for some time (“downtime”) and we will not be liable to any user during downtime.  However, we promise to use all reasonable efforts to keep downtime to a minimum.

We reserve the right to alter or remove any of the services on our website at any time.

If we do not strictly enforce our rights under these terms at any time, we reserve the right to do so in future both in respect of a particular breach and in respect of any future breach.

We reserve the right to terminate services to you without refund if you materially breach these terms.

In the unlikely event that any of these terms and conditions is held to be unenforceable by a court of law, you agree that this will not affect the validity of the remainder of the terms and conditions which will remain in full force and effect.

Any failure by us to exercise or enforce any right or provision of these user terms will not constitute a waiver of that right or provision.
